Thank you for using Tovari! These Terms of Use ("Terms") govern your access to and use of the Tovari marketing website at tovarifinancial.com, the Tovari application at app.usetovari.com, and our mobile apps (together, the "Services"). Tovari is provided by Ewing Technology Partners, LLC, doing business as Tovari Financial ("we," "our," "us"), a Texas limited liability company. When we say "you" or "your," we mean the person or organization that holds a Tovari account or otherwise uses the Services.
By using the Services, now or in the future, you agree to the latest version of these Terms. These Terms contain a limitation of our liability and, in the disclaimer below, make clear that Tovari is not a financial advisor. We may update these Terms from time to time; when we make a significant change, we will refresh the date above and take reasonable steps to notify account holders. If you violate the Terms, we may suspend or terminate your account.
Tovari uses third-party providers, including Plaid, to connect to your financial institutions and retrieve account and transaction data. We do not control your financial institutions or Plaid, and we cannot guarantee that data retrieved through them is complete, accurate, or up to date. Balances, transactions, and categories shown in Tovari may differ from your institution's records, which are the authoritative source. You are responsible for verifying important figures against your bank or card statements. Your use of Plaid is also subject to Plaid's own terms and privacy policy.
You agree not to misuse the Services. Among other things, you may not:
Access to Tovari during early access is by invitation only. We expect to begin sending invitations in August 2026. If you receive an invitation and create an account, your use of the Services is free through September 30, 2026.
Beginning October 1, 2026, continued use of Tovari requires a paid subscription of $11.99 per month (plus any applicable taxes). We will notify you before your free period ends. To keep using the Services on or after that date, you will need to start a paid subscription; if you choose not to, your paid features may become unavailable and your account may be limited or closed in accordance with the Cancellation and termination section below. We do not collect payment information during the free early-access period, and we will not charge you without your having actively signed up for a paid subscription.
Prices, plans, and the free-period end date may change. If we make a change that affects you, we will give reasonable notice and, where a change affects amounts you would be charged, we will present the applicable pricing and terms before you are charged. Except where required by law, payments are non-refundable; please see any subscription terms presented at checkout for details.
We own the software, design, trademarks, and all other materials that make up the Services, except for the content you provide. These Terms do not grant you any right to our name, logos, or branding. You retain all rights to the content and data you put into Tovari; you grant us the limited license needed to operate the Services and provide them to you.
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or that data will be accurate or complete. You use the Services at your own risk.
To the fullest extent permitted by law, in no event will Tovari, its owners, or its suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) the Services — even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Services will not exceed one hundred U.S. dollars ($100), or the amount you paid us in the twelve months before the claim, whichever is greater. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless Tovari and its owners from any claims, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.
These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute that is not subject to arbitration or small-claims court will be the state and federal courts located in Texas, and you consent to their personal jurisdiction.
We may modify these Terms from time to time. The most current version will always be posted here. If a change is material, we will make reasonable efforts to notify you. By continuing to use the Services after changes take effect, you agree to the revised Terms.
